Online Terms of Sale
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE.
1. FORMATION OF THE CONTRACT
These terms of sale (“Terms”) by RCR International Pty Ltd (ABN 21 089 270 360) of Level 2, 3 Joseph Avenue, Chifley Business Park, Moorabbin Airport, Victoria 3194 Australia (PO Box 148, Braeside, Victoria 3195 Australia) and ordered from RCR’s website www.rcr.com.au.
About these Terms and Conditions “we” and “us” mean RCR International Pty Ltd and “you” means the customer.
These Terms should be read carefully before you place an order for goods from RCR. You will be asked to accept these Terms before placing your order. If you do not accept these Terms you should not place an order.
Upon receipt of your order, RCR will automatically send you a confirmation by email to advise we have received your order. No contract exists between you and RCR for the sale of any goods until RCR has received and accepted your order and sends you an invoice by email, to the email address you have given. RCR shall not be under any obligation to accept your order, but once it has done so by sending you an invoice by email there is a binding legal contract between you and RCR.
You must be eighteen (18) years of age or older to order products from the Website and by accepting these Terms you are confirming to us that you are no less than eighteen years of age. You must be eighteen (18) years of age or older to sign for delivery of the order.
RCR may change these Terms without notice to you in relation to future sales.
Prices are for delivery within Australia. For other countries, please contact RCR at firstname.lastname@example.org.
2. REFUND AND DELIVERY POLICY
All goods are subject to availability. If the goods you have ordered are not available, RCR will inform you as soon as possible, and refund you for any sum that has been paid by you or debited from your credit card for the goods. Alternatively, you may elect to wait until the goods become available.
Subject to 2.3 below, the price of the goods will be the price quoted on the Website at the date the order is received. All prices are quoted in Australian dollars (AUD) and include GST. Freight and handling charges are separate, and are specified in the Online Store Information section of the Website. Prices and deliveries are for Australian addresses only.
Every effort will be made to ensure that prices shown on the Website are accurate at the time you place your order. If an error is found prior to despatch of the goods, RCR will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, RCR will refund for any sum that has been paid by you or debited from your credit card for the goods.
The price of the goods shown on the Website is inclusive of GST. A tax invoice will be issued and emailed with the despatch confirmation and will also accompany the goods.
Payment for the goods and freight charges can be made by any credit card that is shown as acceptable on the Website at the time you place your order (presently being Visa, Mastercard and American Express). You can choose to input your card details directly to the National Australia Bank for instant payment and processing, or you can have us call you/you call us for the card details.
Alternatively, PayPal, EFT (Electronic Funds Transfer) or Cheque/Money Order payment options can be selected on the website at the time you place your order.
All deliveries are subject to prior receipt of your payment.
4. DELIVERY POLICY
The goods you order will be delivered to the address you give when you place your order.
Goods ordered via the RCR website will be delivered between 1 – 10 working days. RCR shall not be held responsible for any reasonable or unavoidable delay in delivery.
If delivery cannot be made to your address, the freight company will leave details on a card for you to contact them to arrange a suitable time for re delivery of your order.
A signature will be required on delivery for all RCR goods received.
RCR shall not be responsible for any defect in the goods arising from fair wear and tear, willful damage, accident, negligence by you or any third party.
Subject to paragraph 5.1, if the goods supplied to you are in any way defective or you have any other complaint about the goods, you should contact RCR by phone or notify RCR by post, fax or email in accordance with the contact details at paragraph 9 below.
RCR will not be liable for losses relating to any business (such as lost profits or consequential loss) which arise from any failure by RCR to supply the goods in accordance with the contract.
RCR shall not be held responsible for any delay or failure to comply with its obligations under these terms of sale if the delay or failure arises from any cause which is beyond RCR’s reasonable control. This condition does not affect your statutory rights.
Credit Card Fraud
RCR shall not be responsible for any losses relating to fraudulent or unauthorised use of a credit card.
Under the Trade Practices Act 1974 (“Act”), where implied conditions and warranties cannot be excluded, any liability to RCR for breach of such conditions and warranties (other than a condition or warranty implied by section 69 of the Act) shall be limited, at the option of RCR to the replacement of the product(s) or the re-supply of the same product(s); the payment of the cost of replacing the product(s) or of acquiring equivalent product(s).
RCR will only use the information you provide about yourself for the purpose of fulfilling your order. You can correct any information about you, by going into My Accounts Settings area in the Website. RCR will not pass on any data to any third party, excluding our warehouse and freight contractors.
RCR would like to notify you of similar products and offers that may be of interest to you from time to time. If you do not want to be notified, please tick the appropriate box in Customer Information on the Website. If at any time you wish to receive such information again, you can remove the tick, or email Customer Service at email@example.com.
RCR may use technology to track the patterns of behavior of visitors to the Website and ‘personalise’ your viewing experience. This can include using a ‘cookie’, which would be stored on your browser. The information collected in this way can be used to identify you unless you modify your browser settings. You can usually modify your browser to prevent this happening. However, the Website may not work as well as it might if you switch off cookies.

All copyright in the material contained on the Website and any trademarks and brands included in that material belong to RCR.

These Terms are not intended to and shall not create any rights, entitlements, claims or benefits enforceable by any person other than the person who is party to a contract with RCR for the supply of goods.
These Terms and the supply of the goods by RCR will be subject to Victorian law, and the Victorian courts.
